General Terms and Conditions of Use

1. Preamble
These General Terms and Conditions of Sale (hereinafter referred to as "GTC") govern the sale of products marketed and/or manufactured by RKF HOME (hereinafter referred to as "RKF"), a limited liability company with a share capital of €50,000, whose registered office is located at 5 rue Jacqueline Auriol, Techn’Hom 2, BELFORT (90000), and registered with the Trade and Companies Register of BELFORT under number 917 699 530. The sales are conducted via distance selling on the website www.rkfhome.fr.
For the purposes of these GTC and its business activities, RKF elects its domicile at its registered office.
The term "Client" refers to an individual or natural person placing an order for non-professional purposes and excluding any commercial activity.
Minors who are not legally emancipated may not place an order without the consent of a parent or legal representative.
These GTC are an integral part of the sales contract, and the Client is encouraged to review them prior to placing any order.
The Client acknowledges having been informed that placing an order implies unconditional acceptance of these GTC.
RKF reserves the right to amend these GTC at any time by publishing a new version on its website.
The applicable GTC are those in effect on the date of the order, and they can be consulted, downloaded, and/or printed at any time. RKF also commits to providing a copy by email upon the Client's simple request.
Additionally, the Client is informed that these GTC are complemented by:

Lastly, in accordance with the provisions of Article L.221-5 of the French Consumer Code, the withdrawal form is made available to the Client (Article L221-5 - French Consumer Code - Légifrance) and can also be sent via email upon request to customer service.

3. Products
Each product offered for sale by RKF is accompanied by a detailed description, including its essential characteristics (dimensions, composition, color, contraindications), which can be viewed directly on the product page.
It is noted that dimensional and weight variations of 5% may occur upon delivery, and further variations of 5–10% may occur after multiple wash cycles.
The Client may also contact customer service for further details.
The availability and/or lead times for products are displayed on the product page. RKF commits to providing the most accurate stock information possible. However, for reasons beyond its control, stock information may not be immediately updated, and some products may become unavailable during order processing.
RKF will inform the Client as soon as possible by any means. In the case of temporary unavailability, RKF will inform the Client of the anticipated availability timeframe. The Client may then choose to request the cancellation of the order with a full refund or request an exchange.
In the case of permanent unavailability, the Client will have the same options. The Client is responsible for communicating their choice promptly and through any means. RKF shall not be held liable for delays caused by the Client's lack of response or for subsequent unavailability caused by such delays.
For personalized products, the presence of the base product in stock does not guarantee the immediate availability of the final customized item due to necessary modifications.
Additionally, for customized products, the Client is responsible for carefully verifying the order details and customization specifications before confirming the order.

4. Pricing
Products are supplied at the applicable rates indicated on the website at the time the order is validated.
Prices are subject to change at any time, and RKF shall not be held liable for any price modifications occurring after the order is confirmed.
Prices are displayed in euros and include all applicable taxes.
For EU Member States, prices are shown inclusive of VAT. For orders shipped to French overseas territories or outside the European Union, prices are displayed exclusive of tax.
Any applicable customs duties at the destination will be covered by RKF. Unless otherwise specified, the displayed prices do not include delivery fees, which are detailed separately.
In the event of a pricing error or a manifestly excessive or negligible price due to any reason, the order, even if validated by RKF, may be canceled.
The Client will be informed as soon as possible and may choose to either cancel the order or confirm it at the corrected price.
Promotional offers are subject to specific conditions and limited-time validity. The Client cannot claim a promotional price outside the offer's validity period.

5.Environment
Eco-Contribution
The eco-contribution on furniture is a mandatory fee applied to the price of certain new products, such as mattress toppers, pillows, bolsters, duvets, sleeping bags, and bedding or decorative cushions (fillings).
This contribution, which cannot be discounted, is fully transferred to Ecomaison, a state-approved, nonprofit eco-organization. Its mission includes:
- Collecting the relevant products,
- Ensuring their end-of-life recycling or recovery,
- Promoting their reuse and repurposing.
As such, RKF Home complies with the regulatory obligations defined under Article L.541-10-1 of the French Environmental Code by collaborating with approved eco-organizations.
Triman Logo and Recycling Information
The Triman logo indicates that products or their packaging displaying this logo should not be disposed of with household waste. They must be sorted or deposited at an appropriate collection point.
Recycling instructions are made available:
- Directly on the product or its packaging,
- Or, alternatively, through other means such as a leaflet, manual, or digital document.
Waste generated by RKF is handled in compliance with the Environmental Code and ISO 14001 certification.

6. Orders and Payments
Customers place orders via the dedicated website.
They select the desired products, quantities, and any specific features, adding them to their “cart.”
For customized products, customers must specify personalization details.
Once all products have been added to the cart, the customer is invited to verify its contents carefully before confirming.
Customers must also select a delivery method and pay the indicated shipping costs in addition to the product prices.
The customer validates their order by proceeding with payment.
By confirming the order, the customer acknowledges their obligation to pay the stated amount and fully accepts these Terms of Use.
The order is considered validated once payment information has been verified through the site’s payment systems.
Afterward, an order confirmation page will appear, and an email summarizing the order will be sent to the customer.
The sales contract is then considered formed.
If products are unavailable, RKF will notify the customer as soon as possible, as detailed in Section 3 of these Terms.
Additionally, shipping fees are waived for orders exceeding €250.

Delivery Methods and Timelines:
• Chronopost for France: Up to 48 business hours
• DPD for France: Up to 4 business days
• DPD for the EU: Up to 7 business days
• DHL Eco for non-EU zones: Up to 7 business days
• DHL Express for non-EU zones: Up to 5 business days (subject to customs clearance)
Delivery times vary based on the geographic zone and selected shipping method.
These times are approximate and subject to favorable weather conditions or force majeure.
If the customer does not receive their order within the stated timeframe, they must contact the carrier responsible for their package. Should the carrier’s tracking service fail to locate the package, the customer may email RKF’s customer service, which will open a claim with the carrier.

7. Order Processing and Delivery
Once the order is validated and the contract is formed, RKF commits to processing the order within 30 business days.
For customized products, processing times extend to 60 business days to allow for tailored manufacturing.
RKF reserves the right to cancel or suspend any non-compliant or uncertain order.
These timelines are indicative and may be extended during high-demand periods (e.g., promotions), holidays, or cases of force majeure.
After processing, the order is handed over to the delivery service chosen by the customer during checkout.
Delivery times depend on the carrier and are only indicative.
Upon transferring the order to the carrier, RKF cannot be held responsible for delays in delivery.
Delivery Methods, Timelines, and Costs:
• Chronopost for France: Up to 48 business hours
• DPD for France: Up to 4 business days
• DPD for the EU: Up to 7 business days
• DHL Eco for non-EU zones: Up to 7 business days
• DHL Express for non-EU zones: Up to 5 business days (subject to customs clearance)
The property of the products transfers to the customer upon delivery of the order to the carrier chosen by the customer.

8. Withdrawal – Returns – Exchanges – Refunds
In accordance with Article L. 221-18 of the French Consumer Code, the customer has 14 days to exercise their right of withdrawal without providing a reason.
The withdrawal form is available on the website and can also be sent to the customer upon request.
This 14-day period starts from the day the customer receives their order.
If the order involves multiple shipments, the withdrawal period begins on the day of receipt of the final shipment.
The period begins at the first hour of the first day and ends at the last hour of the final day.
If the period ends on a Saturday, Sunday, or public holiday, it is extended to the next business day.
The customer may exercise their right of withdrawal by notifying RKF of their decision through the withdrawal form or any other unambiguous declaration, sent before the 14-day period expires.
Under Article L. 221-28 of the Consumer Code, the withdrawal right does not apply to personalized products or those made to the customer’s specific request.
Additionally, customers exercising their withdrawal right must not open product packaging. If the packaging is unsealed, the product cannot be returned due to hygiene reasons.
The customer must return the goods to RKF without undue delay and no later than 14 days from notifying RKF of their decision to withdraw.
Return shipping costs are borne by the customer.
RKF will issue a refund on the date the products are received or upon receiving proof of their return shipment. Refunds will be made using the same payment method used for the initial transaction.
The same conditions apply to product exchanges requested at the customer’s discretion.
RKF reserves the right to reject returns of products not in their original packaging or showing signs of use. Return shipping costs for the new product are borne by the customer.
For non-compliant or defective products, RKF will cover return and reshipping costs and will also accept returns of customized products under these circumstances.

9. Product Warranties and Liability
The products are deemed to comply with current French legislation and applicable standards in France.
If, despite this, a product is delivered damaged or defective, the customer is entitled to the legal guarantees of conformity and hidden defects.
Thus, in accordance with the provisions of Articles L. 217-1 et seq. of the Consumer Code, RKF must deliver to the customer a product that conforms to the contract.
A product is deemed compliant if:
• It matches the description, type, quantity, and quality specified, particularly regarding functionality, compatibility, interoperability, or any other characteristic stipulated in the contract.
• It is suitable for any special use sought by the consumer, communicated to the seller no later than at the time of the contract's conclusion, and accepted by the seller.
• It is delivered with all accessories and installation instructions as per the contract.
Additionally, the product is compliant if:
• It is fit for the usual use of goods of the same type, considering applicable European Union and national laws, as well as relevant technical standards or, in the absence of such standards, applicable sector-specific codes of conduct.
• If applicable, it possesses qualities presented by the seller to the consumer through samples or models prior to the contract's conclusion.
• If applicable, it is delivered with all accessories, packaging, and installation instructions that the consumer can reasonably expect.
• It meets the quantity, quality, and other characteristics, including durability, functionality, compatibility, and safety, that the consumer can reasonably expect from goods of the same type, considering the nature of the goods and public declarations made by the seller or their upstream partners, including advertisements or labeling.
The customer has two years from receiving the product to act under the legal guarantee of conformity.
In such cases, the customer is entitled to have the product brought into conformity by repair or replacement, or failing that, to a price reduction or contract termination.
The product must be brought into conformity within a reasonable timeframe, not exceeding 30 days from the customer's request, and without significant inconvenience to the customer, considering the nature of the goods and their intended use.
This compliance will be carried out at no cost to the customer.
Additionally, under the provisions of Articles 1641 et seq. of the Civil Code, RKF is responsible for the guarantee against hidden defects in the sold goods that render them unsuitable for their intended use or diminish their use to such an extent that the buyer would not have purchased them or would have paid a lower price had they been aware of the defects.
This action must be initiated within two years of discovering the defect.
In such cases, the customer may choose between contract termination or a price reduction.
It is noted that a dimensional and weight variation of 5% upon receipt and 5-10% after multiple wash cycles is considered normal wear and tear.
RKF shall not be held liable when non-performance or improper performance of the contract is wholly or partly attributable to the customer or to a force majeure event, as defined in the following article.
Accordingly, all warranties are excluded in cases of misuse, non-compliance with instructions or usage guides, negligence, lack of maintenance, normal wear and tear, or product alteration.
RKF's liability shall also not be engaged in cases of fraudulent use of the customer's password or email address.
Hyperlinks on the Site may direct to other websites.
RKF cannot be held liable if the content of these sites violates current legal and regulatory provisions.
Regardless of the date of product ownership transfer, the transfer of risks relating to loss or damage will only occur when the customer physically takes possession of the products.

10. Force Majeure
Under these GTC, force majeure refers to an unforeseeable, irresistible, and external event affecting the parties.
As such, neither party can be held liable for delays or failure to fulfill obligations resulting from force majeure.
Expressly considered force majeure events include, but are not limited to: social conflicts such as total or partial strikes, internal or external lockouts, civil or military authority intervention, natural disasters, exceptional weather conditions, production halts due to accidental breakdowns, supply disruptions that RKF was not timely informed of, among others.

11. Applicable Law – Dispute Resolution
These GTC and the contractual relationship between RKF and the customer are governed by French law.
Any dispute regarding the interpretation, performance, or termination of these GTC will be subject to the sole jurisdiction of French courts, in accordance with the competency rules set forth by French law.
The customer may also, before bringing the matter to court, write to RKF in an effort to amicably resolve the dispute.
RKF will make every effort to achieve such an outcome.
If this amicable approach does not satisfy the customer, they may refer the matter to a mediator free of charge, as per the following procedures:

Claims submitted through this platform will be forwarded to the appropriate national mediators.
